How a Recall Works
What are the grounds for recall?
The grounds for recall of a regional school board member are:
(1) misconduct in office,
(2) incompetence, or
(3) failure to perform prescribed duties.
What is the recall process?
(1) An application is filed with the director of elections.
(2) A statement of 200 words or less, that explains the
grounds, is submitted.
(3) The director with certify or deny the recall application.
(4) If approved, recall petition booklets are issued.
(5) Signatures must be collected and verified from a minimum of 25% registered Juneau voters.
(6) If the required number of signatures are approved the
recall be placed on the ballot.
How were board members for recall selected?
The state has clear guidelines for recall as outlined in
Alaska Statutes 14.08.081, Alaska Statutes 29.26.240 through 29.26.360 and Title 6 Alaska Administrative Code 25.240.
(1) A recall petition cannot be submitted within 120 days of the term of office.
(2) A recall petition must be completed within 180 prior to the termination of office.
Why is only one violation listed on the Recall and not all of the violations as submitted on the original petition?
The Board of Education is supposed to follow the policies as described in the board policy. The JSD Board of Education failed to follow their own board policies throughout the consolidation process. After filing complaints with the school district, members of CARE reached out to DEED (the Department of Education and Early Development) and AASB (Alaska Association of School Boards) for assistance. It was through this process CARE learned the only way to hold the Board of Education responsible for their actions was through recall. Since the state must verify the grounds for recall, all violations were reviewed by the CBJ attorney who removed all but one violation.
Signature Collection
A finalized affidavit and application must be filed with the city clerk. The petitioners were given 60 days to collect a minimum of 2,359 (25% of all qualified voters in the previous election) signatures. If the required number of signatures are collected but not approved in the first phase, the petitioners are granted an additional 10 days to cure any errors (i.e. illegible signature, address match, etc.) If/when the required number of signatures are collected and certified by the governing body, the recall is placed on the ballot.
